This petition has been filed challenging a Government Order
dated 09.01.2018 laying down guiding principles for
recruitment to be made for Assistant Teacher recruitment
Examination, 2018. This Government Order specifies the
syllabus on the basis of which examination has to be conducted.
40 marks are allotted for language, which contains Hindi,
Sanskrit and English.
The grievance of the petitioner is with regard to exclusion of
Urdu as one of the language in the syllabus.
It is contended that in the regulations framed by NCTE, the
second language consists of English / Urdu / Sanskrit. In the
two years BTC Course also Sanskrit and Urdu are the optional
subjects in first and third semester. It is contended that if Urdu
is eliminated from the syllabus for the purposes of accord of
marks, those, who have taken Urdu as a subject would be put to
a disadvantageous position, inasmuch as their merit would be
adversely affected.
While entertaining the writ petition instructions were called.
The Director in the instructions given to the State Counsel has
stated that Urdu is not the subject in the primary section.
Whether or not, Urdu is included in primary section is not the
question. While examining the merits of applicants who are to
be recruited for the post, the syllabus taught to them in relevant
examinations would have to be taken into consideration for
determining their merits. Once, Urdu and Sanskrit were
optional subjects, both in TET and BTC examination, the
applicants who have passed these examination with Urdu would
stand to loose inasmuch as no marks would be allocated to them
for having studied Urdu.
Learned Standing Counsel and Sri A.K. Yadav, learned counsel
have pointed out that examinations have been deferred as of
now.
In such circumstances, it will be appropriate to direct the
Additional Chief Secretary of the Department concerned to
specifically examine this aspect and to file his personal affidavit
within ten days.
