It has been submitted by learned counsel for the petitioner that
the benefit of leave encashment is not being paid to the
petitioner though he is entitled to the same in light of the
Division Bench judgement of this Court rendered on
02.02.2016 in Special Appeal Defective No.25 of 2016, Uttar
Pradesh Basic Shiksha Parishad, Allahabad and another vs.
Dharndihar Dubey. The said judgment of the Division Bench
has been annexed as annexure 6 to the writ petition.
Be that as it may, without entering into the merits of the case,
this petition is disposed of finally with the direction to the
Secretary, Basic Shiksha Parishad, Allahabad to consider the
claim of the petitioner and take a final decision in the matter
strictly in accordance with law and also taking into account the
Division Bench judgement rendered by this Court on
02.02.2016 in the case of Dharnidhar Dubey (supra). For the
aforesaid purpose, the petitioner will be at liberty to make
representation to the Secretary, Basic Shiksha Parishad,
Allahabad setting out all their grievances and taking all pleas
which may be available to him and annexing all the documents
on which the intends to rely including a copy of the judgment
dated 02.02.2016 rendered by this Court in the case of
Dharnidhar Dubey (supra) within fifteen days. If such a
representation is made, the same shall be considered and
decided by the Secretary, Basic Shiksha Parishad, Allahabad by
passing a speaking and reasoned order within next two months
from the date of production of a certified copy of this order
along with representation to be made by the petitioners.
