After considering the provisions of the Right to Free and Compulsory Education Act 2009, prima facie we find that the same infact regulates the standards of education, infrastructure, teaching etc. in respect of institutions which receive aid from the government or have been established and are being run by Government/State or Central or Local Bodies etc. Prima facie we find that the provisions of the Act cannot be attracted in relation to the institution which are unaided and have no recognition from any statutory body.
At this stage learned counsel for respondent no.3 namely District Basic Education Officer, Mau seeks time to examine the matter. We also direct the learned Standing Counsel to have instruction in the matter by the next date.
