इलाहाबाद : इलाहाबाद हाईकोर्ट ने प्रदेश में सार्वजनिक व निजी भागीदारी में मॉडल स्कूल चलाने के राज्य सरकार के फैसले को नीतिगत माना है तथा सरकारी फैसले के खिलाफ याचिका खारिज कर दी है। यह आदेश मुख्य न्यायाधीश डॉ. डीवाई चन्द्रचूड़ तथा न्यायमूर्ति यशवन्त वर्मा की खंडपीठ ने शशांक शेखर पांडेय की जनहित याचिका पर दिया है।

The petitioner seeks to challenge a policy decision of the State Government dated 28 September 2015 as communicated by the Principal Secretary to the Director of Education (Secondary) in the State.
It appears from the disclosure made to the petitioner on 20 November 2015 under the Right to Information Act by the Union Government in the Ministry of Human Resource Development that the model school scheme was in pursuance of the recommendation of the Fourteenth Finance Commission delinked from Government of India support.
The scheme has been transferred to the States and Union Territories from the financial year 2015 - 16 and the State Governments have to run the model school scheme in accordance with law with their requirement. The Government of India took this decision since a higher share of the Union Government Net Tax receipts was being devolved to the States under the recommendations of the Fourteenth Finance Commission.
The communication dated 28 September 2015 of the Principal Secretary to the Director of Education (Secondary) indicates that following the model school scheme being delinked from Union support and aid, the State Government had taken a decision to conduct and run the schools under the model schemes on a public private partnership basis. This is a pure issue of policy on which the Court cannot prevent the State Government from taking an appropriate decision to run the scheme in a manner which would best subserve the budgetary requirements of the State.
Evidently, it is for the State Government to run the model school scheme in a manner which would be consistent with the meeting of expenditure and budgetary norms.
The matters is a pure issue of policy in which the Court cannot enter. Hence, we decline to entertain the writ petition which is accordingly dismissed.
There shall be no order as to costs.
