Heard learned counsel for the petitioners and the learned Standing Counsel for the respondents.

By means of the present writ Petition, the petitioners are seeking quashing of the order dated 8.7.2015 passed by Basic Siksha Adhikari, Baghpat, whereby five days salary of the teachers and five days honorarium of Siksha Mitra has been withheld on the ground that they have not been performed their duties on Backward Class Rapid Survey.

The submission is that this Court vide judgment dated 25.3.2015, passed in PIL No. 11028 of 2015(Sunita Sharma, Advocate High Court and anothers vs. State of UP. and others has held that the State and the District Administration shall not requisition the services of the teachers in Primary Schools and Junior High Schools for carrying out such work which is without the authority of law. At the same time, the State and its agencies would be at liberty to make all appropriate arrangements including by recruiting contractual employees if it is so considered necessary for carrying out ministerial duties, such as the verification of eligible families for the allotment of ration cards. Attention was also drawn to an order dated 22.5.2015 passed in Contempt Application(Civil) No. 3279 of 2015.

In view of the aforesaid, since purely legal issue is involved in the present petition, no fruitful purpose would be served by calling for a counter affidavit and keeping this writ petition pending.

In view of the Judgment in PIL No. 11028 of 2015 as noted above, the order impugned herein dated 8.7.2015 passed by respondent No. 2 is quashed matter is remanded back to respondent No. 4 for passing orders afresh. The petitioners are permitted to file a fresh representation before the respondent No. 4 alongwith certified copy of this order.

With the aforesaid observations, this writ petition is disposed of.
